These Terms of Service ("Terms") govern your access to and use of the Jackson Hole Outdoor Pursuits website located at jacksonholeoutdoorpursuits.com (the "Site") and the booking of any activities, experiences, or services offered through the Site (collectively, the "Services"). By accessing the Site or purchasing any Services, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Us

Jackson Hole Outdoor Pursuits is an outdoor activity booking service operating in Jackson Hole, Wyoming. We connect guests with licensed and insured local outfitters, guides, and experience providers ("Operators"). Jackson Hole Outdoor Pursuits acts as a booking facilitator and is not itself the provider of the underlying outdoor activities.

2. Eligibility

You must be at least 18 years of age to make a booking through this Site. By completing a booking you represent that you are 18 or older, or that you are booking on behalf of a family unit and accept these Terms on behalf of all participants. You are responsible for ensuring that all participants in any booked activity meet any age, health, weight, or fitness requirements specified by the Operator.

3. Bookings and Payment

All bookings are subject to availability and confirmation. Prices displayed on the Site are in U.S. dollars and are subject to change without notice until a booking is confirmed. Payment is due in full at the time of booking. We accept major credit cards and other payment methods as presented at checkout. Your receipt of a booking confirmation email constitutes our acceptance of your booking.

Jackson Hole Outdoor Pursuits reserves the right to cancel any booking in the event of circumstances beyond our reasonable control, including but not limited to severe weather, natural disaster, or Operator cancellation. In such cases, a full refund will be issued.

4. Cancellations and Refunds

Cancellations made more than 72 hours before the scheduled activity date are eligible for a full refund. Cancellations made within 72 hours of the activity are non-refundable. No-shows are non-refundable. Refunds, where applicable, will be issued to the original payment method within 5–10 business days. All cancellation requests must be submitted in writing to info@jacksonholeoutdoorpursuits.com.

5. Assumption of Risk

Outdoor activities — including but not limited to whitewater rafting, rock climbing, via ferrata, horseback riding, mountain biking, hiking, and off-road touring — involve inherent risks of injury, death, and property damage. By booking any activity through this Site, you voluntarily assume all risks associated with participation, including risks arising from the actions or omissions of other participants, the condition of equipment, and the forces of nature.

Certain activities will require you to sign a separate liability waiver directly with the Operator prior to participation. Failure to sign any required waiver may result in forfeiture of your booking without refund.

6. Health and Safety

You are responsible for disclosing any medical conditions, physical limitations, or disabilities that may affect your ability to safely participate in a booked activity. Jackson Hole Outdoor Pursuits and its Operators reserve the right to refuse participation to any guest whose condition poses a safety risk to themselves or others. In such cases, refunds are at the Operator's sole discretion.

7. Intellectual Property

All content on this Site — including text, photographs, graphics, logos, and software — is the property of Jackson Hole Outdoor Pursuits or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without our prior written consent.

8. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. JACKSON HOLE OUTDOOR PURSUITS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY WYOMING LAW, JACKSON HOLE OUTDOOR PURSUITS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PARTICIPATION IN ANY ACTIVITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO JACKSON HOLE OUTDOOR PURSUITS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Jackson Hole Outdoor Pursuits, its affiliates, Operators, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your participation in any activity, your violation of these Terms, or your violation of any rights of another person or entity.

11. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to the Site or Services shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Teton County, Wyoming. You consent to the personal jurisdiction of such courts and waive any objection to venue in Teton County, Wyoming.

Before initiating any formal legal proceeding, you agree to first contact Jackson Hole Outdoor Pursuits at info@jacksonholeoutdoorpursuits.com and provide us a reasonable opportunity to resolve the dispute informally.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
